This web site ("Site") and related services are provided by University of Miami d/b/a UHealth ("UHealth") to its patients subject to compliance with the terms and conditions set forth below. Please read the following information carefully. Your continued use of this Site will indicate your agreement to be bound by the terms and conditions set forth below. If you do not agree to be bound by these terms and conditions, then you will not be granted access to MyUHealthChart and you should promptly exit this Site.
Your privacy is of the utmost importance to us. UHealth will use your confidential health information in order to provide you health care services. UHealth will, at all times, maintain your confidential health information in confidence. Please review the UHealth Notice of Privacy Practices for a thorough description of how we gather, use and protect your confidential medical information. All messages sent and received within MyUHealthChart that contain health information are subject to Florida and federal laws governing the security and confidentiality of medical records.
II. MyUHealthChart Features
A. Electronic Messaging
We anticipate responding promptly to electronic messages. However, MyUHealthChart should never be used for urgent matters. Therefore, for all urgent medical matters, please contact your physician's office by phone, go to an emergency room, or dial 911.
If your provider is out of the office or unavailable, messages sent via MyUHealthChart may be routed to other authorized caregivers within UHealth in order to facilitate a timely response to your request. Please know that if you send UHealth an e-mail communication, it may be shared with UHealth staff who assist the physician in providing your medical care. Your information on MyUHealthChart will be accessible to appropriate clinical staff and to other medical providers involved in your care.
You agree that all messages that are sent through MyUHealthChart will be regarding your health care and conditions. You understand that asking for advice for a friend or family member is not allowed. Since these messages, along with any other information you may include in your MyUHealthChart, may become a part of your permanent medical record and will be perceived as your health information, it is important that no one else's information be reflected in your messages.
Without your authorization, health information may be released to your insurance for payment of your health care claims and to other providers involved in your healthcare.
In addition, the University of Miami may share your health records with other health care providers involved in your care. The University of Miami and your providers may share this information with each other as needed to provide you treatment and carry out services related to your treatment. You understand that this information will be shared primarily through electronic health record systems where all of the health care providers may exchange information to provide treatment to you.
B. Secure Communications
All communications between you and UHealth using MyUHealthChart occur over a secure connection. You will receive Internet e-mail messages notifying you that new information is available in your MyUHealthChart account. These e-mail messages, however, will not contain any confidential medical information. All of the confidential health information available to you in MyUHealthChart is protected and securely maintained by UHealth. It is your responsibility to monitor these messages and respond in an appropriate manner. You must provide UHealth with a valid e-mail address and any updated information.
Since you will be receiving notifications via e-mail, this means that any person with access to your e-mail will be able to see this notification. This could include your spouse, employer or anyone else that can access your e-mail account. Although no private health information will be sent to you via e-mail, the e-mail notification may be information that you would not want others to know. Therefore, if others have access to your e-mail, you should take this into account when providing an e-mail address for the MyUHealthChart.
C. Access Code
When you initially enroll in MyUHealthChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal login name (called "myuhealthchart User Name") and a password. Once this access code has been used it will no longer be valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that your security has been compromised. You may change your password at any time.
III. Information Does Not Constitute Medical Advice
UHealth assumes no responsibility for how you use the information you obtain from this Site. You should consult with a physician or other health care provider regarding your own condition and how this Site content may or may not apply to you.
You may be accessing your own health information via the MyUHealthChart application and may wish to communicate with one of your health care providers about your health information. If you have an emergency, or think you need to speak to someone urgently, please do not use the email communication options provided to you by MyUHealthChart. Neither MyUHealthChart nor any other application available through this Site is a substitute for appropriate and timely contact with your physician.
This Site is not a substitute for consultation with your physician. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.
IV. Termination of Access
Access to the MyUHealthChart system is granted to users for the purpose of furthering their medical care. UHealth may restrict or terminate access to MyUHealthChart at any time and for any reason. Use of the system unrelated to the purpose of furthering your medical care may result in the suspension or termination of access privileges. Other improper activities include, but are not limited to: use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled and other activities that are deemed to cause a disruption to clinic operations in the sole discretion of UHealth.
If access is restricted for planned maintenance of the MyUHealthChart system, every effort will be made to communicate downtime to all users in advance. However, there may be reasons to restrict access to MyUHealthChart without advance notice. If your use of MyUHealthChart violates these Terms and Conditions, UHealth reserves the right to permanently terminate your access to MyUHealthChart.
In addition, anyone you grant authorization to review your information on MyUHealthChart will not have access to your information once we receive notification of your death. Any requests for medical records will have to be made in accordance with UHealth policy and Florida law.
V. Restrictions on Use and Ownership
All pages within this Site and any material made available for download are the property of UHealth and/or its subsidiaries and affiliates. The content on the Site is provided for UHealth and its patients only. The words "University of Miami" "UHealth" or "UHealth System" and all associated corporate logos are the trademarks and service marks of University of Miami, Inc. All other trademarks, service marks, and logos used in this Site, including but not limited to MyUHealthChart and Epic, are the trademarks, service marks, or logos of their respective owners. Nothing on this Site should be construed as granting any license or right to use any trademark, service mark, or logo displayed on this Site without the express permission of UHealth or the third party that may own the trademark, service mark, or logo.
VI. Accuracy, Completeness and Integrity of Information
Information on MyUHealthChart is provided "as is" without warranty of any kind and is meant only to support the patient's relationship with his/her current or future health care provider(s). Your reliance on the information in MyUHealthChart is at your own risk.
Certain information that you include in MyUHealthChart, along with electronic messages, may become a part of your permanent medical record. However, the information displayed in MyUHealthChart may not be the complete medical record. Posting of your health information is at the discretion of your individual physician(s). In addition, certain laboratory test results will not automatically be available on the MyUHealthChart system, but rather will be withheld and may subsequently be released manually by your physician. If the health information is not posted in MyUHealthChart, you should contact UHealth directly for copies of your medical record(s).
Although UHealth attempts to ensure the integrity of the Site, it makes no guarantees whatsoever as to the correctness, completeness or accuracy of the Site. It is possible that the Site could include typographical errors, inaccuracies or other errors. In the event that an inaccuracy arises, please inform UHealth by sending a secure message through the Ask Customer Service page in MyUHealthChart. Information is also available on the MyUHealthChart FAQ page about how to correct information displayed in MyUHealthChart. Information contained on the Site may be changed or updated without notice.
VII. Links to Other Sites
UHealth makes no representations whatsoever about any other web site that you may access through this site or any entity that may post its advertisements on this Site. When you access a non-UHealth site, please be advised that it is independent from UHealth, and that UHealth has no control over the content on that web site. UHealth does not endorse or accept any responsibility for the content or use of any other linked site. If you decide to access any third party sites linked to this Site, you do so entirely at your own risk.
VIII. Proxy Access
You may grant another individual proxy access to your MyUHealthChart by completing the applicable adult proxy and authorization forms and submitting them to UHealth.
You may also obtain proxy access to your minor child/legal wardís MyUHealthChart by completing the child proxy form and submitting it to UHealth. Proxy access to a minorís MyUHealthChart will only be granted to persons with parental rights, legal guardianship or durable power of attorney for healthcare over the minor and only to the extent that the individual requesting proxy access can demonstrate the legal right to the minorís health information. In addition, proxy access to a minorís record will be automatically revoked when the minor turns 12 years old. You may obtain proxy access to the minorís MyUHealthChart after he turns 12 years old, but only if the minor agrees to grant such proxy access.
Under Florida law, UHealth cannot provide a proxy access to certain types of health information (such as HIV testing) without the consent of the minor patient. In addition, UHealth has the sole discretion to determine whether such health information will be included in MyUHealthChart.
A MyUHealthChart account will be activated for the proxy. If the proxyís legal relationship with the patient changes, you and/or the proxy must inform UHealth immediately by contacting us at AskMyUHealthChart@med.miami.edu or by sending a secure message through the Ask Customer Service page. UHealth reserves the right to revoke proxy access at any time in its sole discretion.
As a proxy, you agree to these limitations on access to a patientís health information in MyUHealthChart.
You understand that UHealth reserves the right in the future to charge a fee for the use of MyUHealthChart. You will be notified of this change and asked to re-apply if you agree to the fee and wish to continue with this service.
UHealth shall not be liable for any damages suffered by you or other third parties related to, directly or indirectly, the material and information contained in MyUHealthChart. In no circumstances will UHealth be liable to you or any other person for direct, indirect, special, incidental or consequential damages of any type, even if informed of the possibility of such damages. UHealth cannot guarantee access to the MyUHealthChart system and is not liable for your inability to access or view the information contained on the site. By downloading or viewing the information on MyUHealthChart, you agree to hold UHealth harmless against any damages, claims, or other claims asserted against UHealth arising out of, or in any way connected with, your utilization of MyUHealthChart or the information contained therein.
This Agreement shall be governed by the laws of the State of Florida and any dispute arising hereunder shall be submitted to a court of competent jurisdiction located in Miami, Florida. This Agreement, along with any proxy or authorization forms you sign with regard to MyUHealthChart, contain the entire agreement between the parties with respect to the subject matter contained herein and such Agreement shall not be modified or amended, except at the discretion of UHealth and updated terms will be posted on the MyUHealthChart website for user access.
